By accessing or using the Services, creating an account, or otherwise indicating your acceptance (including by clicking "I agree" or similar), you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

These Terms form a binding agreement between you, whether individually or on behalf of an entity ("you" or "User"), and the Company. If you use the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" will refer to both you and that organization.

We may update or modify these Terms from time to time. If we make material changes, we will provide notice by updating the "Effective Date" above and, where appropriate, providing additional notice through the Services or by email. Your continued use of the Services after such changes become effective constitutes your acceptance of the revised Terms.

2. Definitions

For purposes of these Terms, the following definitions apply:

  • "Account" means a registered account created by a User to access and use the Services.
  • "Applicable Law" means all laws, regulations, and legal requirements applicable to your use of the Services, including data protection, privacy, and export control laws.
  • "Bandwidth" means the amount of data transferred through the Services, typically measured in gigabytes (GB), and consumed by your use of proxy services.
  • "Content" means any data, information, text, files, or materials transmitted, processed, or otherwise handled through the Services.
  • "Proxy Services" means the network access services provided by the Company, including residential, mobile, datacenter, ISP, or other proxy solutions.
  • "Services" has the meaning set forth in Section 1 and includes the Site, dashboard, APIs, and Proxy Services.
  • "Top-Up" means a prepaid credit added to your Account balance, which may be used to access and consume the Services.
  • "User," "you," or "your" means any individual or entity accessing or using the Services.
  • "User Content" means any Content submitted, transmitted, routed, or otherwise processed by you through the Services.

Additional terms may be defined within these Terms and shall have the meanings ascribed to them where they appear.

4. Eligibility & Account Registration

4.1 Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction (whichever is higher), to use the Services. By using the Services, you represent and warrant that you meet this requirement.

If you are using the Services on behalf of a business or legal entity, you represent and warrant that you have the legal authority to bind that entity to these Terms.

4.2 Account Registration

To access certain features of the Services, you must create an Account. When registering for an Account, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your information as necessary; and
  • Not impersonate any person or entity or misrepresent your affiliation.

4.3 Verification

We reserve the right, in our sole discretion, to request additional information to verify your identity or eligibility to use the Services. Failure to provide such information may result in suspension or termination of your Account.

4.4 Account Approval

We reserve the right to approve or reject any Account registration at our discretion, including where we believe that the registration poses a risk to the security, integrity, or lawful operation of the Services.

5. Account Security & Responsibility

You are solely responsible for maintaining the confidentiality and security of your Account credentials, including your username, password, API keys, and any other authentication information.

You agree that:

  • You will not share your Account credentials with any unauthorized person;
  • You are responsible for all activities that occur under your Account, whether or not authorized by you;
  • You will immediately notify us of any unauthorized access to or use of your Account or any other security breach.

The Company shall not be liable for any loss or damage arising from your failure to comply with this Section, including unauthorized use of your Account.

We reserve the right to suspend or terminate your Account, or reset your credentials, if we reasonably believe that your Account has been compromised or is being used in violation of these Terms.

6. Description of Services

6.1 Overview

The Company provides Proxy Services and related infrastructure that enable Users to route internet traffic through various networks, including residential, mobile, datacenter, and ISP-based proxy networks.

The Services may be accessed through the Site, a user dashboard, APIs, or other technical interfaces provided by the Company.

6.2 Service Model

The Services operate on a prepaid, account balance model. Users may add funds to their Account ("Top-Ups"), which are credited as a prepaid balance that may be used to purchase access to specific proxy services, plans, or features made available by the Company.

Top-Ups represent prepaid credits and do not, in themselves, grant access to any specific proxy services. Access to the Services is obtained by selecting and purchasing a particular proxy plan or offering, at which point the applicable amount will be deducted from the User's Account balance.

Once a proxy plan or service is purchased, the scope of access, pricing, duration, and any applicable usage limits (including Bandwidth or other metrics) will be governed by the terms of that specific plan as presented within the Services.

The Company reserves the right to modify, update, or discontinue any aspect of the Services, including available plans, pricing structures, or billing models, at any time, provided that such changes will not retroactively affect completed transactions.

The Company does not guarantee any specific level of performance, success rate, or outcome from the use of the Services, and Users are solely responsible for selecting appropriate plans and managing their usage.

6.3 Service Availability

The Services are provided on an "as available" basis. While we strive to maintain reliable access, we do not guarantee that the Services will be uninterrupted, error-free, or available at all times.

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, including for maintenance, upgrades, or security reasons.

6.4 Technical Nature of Services

The Services involve complex networking infrastructure and third-party dependencies. Performance, latency, availability, and routing may vary based on factors outside the Company's control.

You acknowledge and agree that:

  • The Services are intended for lawful and legitimate use;
  • The Company does not control or endorse any third-party content accessed through the Services; and
  • Use of the Services may be subject to limitations, restrictions, or interruptions inherent to internet-based systems.

6.5 No Guarantee of Anonymity or Untraceability

While the Services may facilitate routing of internet traffic through proxy networks, the Company does not guarantee anonymity, untraceability, or the inability of third parties to identify or track your activities.

You are solely responsible for your use of the Services and for ensuring compliance with all Applicable Laws.

6.6 Modifications to Services

The Company reserves the right to modify, update, suspend, or discontinue any aspect of the Services, including features, functionality, or pricing structures, at any time and without liability.

Such modifications may be made for operational, technical, legal, or business reasons.

6.7 No Legal Compliance Guarantee

The Services are not designed or intended to ensure compliance with any specific legal or regulatory requirements. You are solely responsible for ensuring that your use of the Services complies with all Applicable Laws.

7. Permitted Use of Services

You may use the Services solely for lawful purposes and in accordance with these Terms and all Applicable Laws.

You agree that you will:

  • Use the Services only in a manner consistent with their intended purpose;
  • Comply with all applicable laws, regulations, and third-party rights; and
  • Ensure that your use of the Services does not infringe, misappropriate, or otherwise violate any rights of any person or entity.

You are solely responsible for determining whether your use of the Services complies with Applicable Laws, including laws relating to data protection, privacy, intellectual property, and computer misuse.

You further agree to comply with the terms, conditions, and policies of any third-party services, websites, or platforms that you access, interact with, or collect data from using the Services. The Company does not authorize or permit the use of the Services in violation of any such third-party terms or applicable legal restrictions.

7.1 API Usage & Rate Limiting

Where the Services are accessed via APIs or automated systems, you agree to comply with any technical limitations, rate limits, and usage guidelines established by the Company.

The Company reserves the right to monitor, throttle, restrict, or suspend API access where necessary to prevent abuse, ensure system stability, or enforce these Terms.

7.2 High-Risk Use Restrictions

You agree not to use the Services in connection with any activities where failure or misuse of the Services could result in significant harm, including but not limited to healthcare decision-making, financial decision-making, surveillance activities, or other high-risk applications.

8. Prohibited Uses (Acceptable Use Policy)

You agree not to use, and not to permit any third party to use, the Services for any unlawful, abusive, or otherwise prohibited purpose. Without limiting the foregoing, you shall not:

8.1 Illegal Activities

  • Use the Services in violation of any Applicable Law;
  • Engage in fraud, identity theft, or deceptive practices;
  • Facilitate or participate in any criminal activity.

8.2 Network Abuse & Interference

  • Interfere with or disrupt the integrity, performance, or availability of the Services;
  • Attempt to gain unauthorized access to any system, network, or account;
  • Circumvent or attempt to bypass any security measures, authentication systems, or access controls.

8.3 Data Collection & Scraping Misuse

  • Use the Services to access, collect, or scrape data from third-party websites or services in violation of their terms of service or Applicable Law;
  • Engage in activities that may impose an unreasonable or disproportionately large load on third-party systems.

8.4 Malicious or Harmful Conduct

  • Distribute malware, viruses, or other harmful code;
  • Engage in phishing, spamming, or other abusive messaging practices;
  • Use the Services for harassment, stalking, or any form of abusive conduct.

8.5 Circumvention of Restrictions

  • Use the Services to bypass restrictions imposed by websites, platforms, or legal frameworks where such circumvention is unlawful or in breach of binding contractual obligations.

8.6 High-Risk or Prohibited Use Cases

  • Use the Services in connection with activities involving child exploitation, human trafficking, terrorism, or other serious crimes;
  • Use the Services in any manner that may expose the Company to regulatory or legal liability.

The Company reserves the right to determine, in its sole discretion, whether any use of the Services violates this Section.

9. Monitoring, Enforcement & Suspension

9.1 Monitoring

The Company does not generally monitor User Content or activities; however, we reserve the right to monitor usage of the Services to the extent necessary to:

  • Ensure compliance with these Terms;
  • Detect, prevent, or investigate fraud, abuse, or security incidents; and
  • Protect the integrity and availability of the Services.

9.2 Enforcement Actions

If we reasonably believe that you have violated these Terms or that your use of the Services poses a risk to the Company, other users, or third parties, we may take any action we deem appropriate, including:

  • Issuing warnings;
  • Limiting or restricting access to the Services;
  • Suspending or terminating your Account;
  • Blocking specific activities or requests; and
  • Reporting your activities to relevant authorities.

9.3 Immediate Suspension

We may suspend your access to the Services immediately, without prior notice, where we reasonably determine that your use:

  • Violates these Terms or Applicable Law;
  • Poses a security, legal, or reputational risk to the Company or third parties;
  • Involves suspected fraud, abuse, or misuse; or
  • Is required to be restricted by law or a regulatory authority.

9.4 Cooperation with Authorities and our Company

We may cooperate with law enforcement or regulatory authorities in relation to any investigation of alleged unlawful activity, including by providing information where required or permitted by Applicable Law.

You also agree to reasonably cooperate with the Company in any investigation of suspected misuse, fraud, or violation of these Terms, including by providing information or assistance where required.

10. Top-Ups, Billing Model & Usage

10.1 Prepaid Model

The Services operate on a prepaid basis. You must add funds ("Top-Ups") to your Account, which are then used to access and consume the Services.

Top-Ups represent prepaid credits and do not constitute a purchase of any specific quantity of proxy services. Access to the Services is contingent upon maintaining a sufficient Account balance.

10.2 Usage-Based Consumption

Your Account balance will be reduced based on your use of the Services, including Bandwidth consumption and any other applicable usage metrics communicated by the Company.

You acknowledge and agree that:

  • Usage is measured using the Company's systems, which shall be final and binding;
  • Different proxy types or features may be subject to different pricing models; and
  • Rates and billing methods may be updated from time to time.

10.3 No Guarantee of Results

The Company does not guarantee any specific performance, success rate, or outcome from your use of the Services. You are solely responsible for how you use the Services and any results obtained.

10.4 Insufficient Balance

If your Account balance is insufficient, your access to the Services may be limited, suspended, or restricted until additional Top-Ups are made.

10.5 Non-Transferability

Unless otherwise expressly permitted by the Company, Account balances are non-transferable, non-exchangeable, and may not be resold.

10.6 No Resale or Redistribution

You may not resell, sublicense, share, or otherwise make the Services available to any third party, whether on a commercial or non-commercial basis, without the Company's prior written consent.

The Company reserves the right to suspend or terminate any Account that is used for unauthorized resale or redistribution of the Services.

11. Pricing, Taxes & Payment Processing

11.1 Pricing

All prices for the Services are displayed on the Site or within the dashboard and are subject to change at any time. Any changes in pricing will not apply retroactively to Top-Ups already completed.

11.2 Taxes

You are responsible for any applicable taxes, duties, or governmental charges associated with your use of the Services, including value-added tax (VAT), sales tax, or similar charges, except where such taxes are required to be collected and remitted by the Company.

11.3 Payment Processing

Payments are processed through third-party payment processors. By making a payment, you agree to comply with the terms and conditions of such payment processors.

The Company does not store or process your full payment card details. Payment information is handled directly by the payment processor in accordance with its own privacy and security practices.

The Company is not responsible for the performance, security, or practices of any third-party payment processor, and your use of such services is at your own risk.

11.4 Payment Authorization

By initiating a Top-Up, you authorize the Company and its payment processors to charge your selected payment method for the specified amount, including any applicable taxes and fees.

11.5 Failed or Reversed Payments

If a payment is declined, reversed, or otherwise fails, we may:

  • Suspend or restrict your access to the Services;
  • Reverse any corresponding credits; and
  • Recover any outstanding amounts owed by you.

12. Fraud Prevention & Payment Screening

12.1 Fraud Prevention Measures

To protect the integrity of the Services and prevent fraudulent activity, the Company uses automated and manual fraud detection systems, including third-party payment screening tools.

These systems may analyze transaction data, device information, location data, and other relevant signals to assess the risk associated with a transaction.

12.2 Transaction Review & Blocking

The Company reserves the right to:

  • Review any transaction for fraud or compliance purposes;
  • Reject or cancel any payment or Top-Up; and
  • Suspend or terminate Accounts associated with suspected fraudulent activity.

12.3 User Acknowledgment

By using the Services, you acknowledge and agree that:

  • Your transactions may be subject to automated and manual risk assessments;
  • Such assessments may result in delays, restrictions, or denial of service; and
  • The Company shall not be liable for any loss arising from the implementation of fraud prevention measures.

12.4 Chargebacks & Disputes

Initiating a chargeback or payment dispute without a valid basis may constitute a breach of these Terms. In such cases, the Company reserves the right to:

  • Immediately suspend or terminate your Account;
  • Recover any outstanding amounts owed; and
  • Take further action as permitted by law.

13. Refunds, Credits & Cancellation

13.1 General Refund Policy

All Top-Ups are final, except as expressly provided in this Section. Refunds are only available within seven (7) days from the date of the relevant Top-Up.

13.2 Prorated Refunds Based on Usage

Where a refund request is submitted within the applicable refund period, the Company may, in its discretion, provide a refund for any unused portion of the Top-Up.

For usage-based Services, refunds will be calculated on a prorated basis, taking into account the amount of Bandwidth or Services already consumed. Any portion of the Services that has been used is non-refundable.

13.3 Expired Refund Eligibility

No refunds will be provided for any Top-Up where:

  • The refund request is made more than seven (7) days after the Top-Up;
  • The relevant balance has been fully consumed; or
  • The Account has been suspended or terminated due to a breach of these Terms.

13.4 Chargebacks

If you initiate a chargeback or payment dispute without first contacting the Company and providing a reasonable opportunity to resolve the issue, we reserve the right to:

  • Suspend or terminate your Account;
  • Void any associated credits; and
  • Recover any outstanding amounts owed.

13.5 Method of Refund

Refunds, if approved, will be issued using the original payment method, unless otherwise required by Applicable Law.

13.6 EU Consumer Rights

If you are a consumer located in the European Economic Area, you may have a statutory right to withdraw from certain purchases within fourteen (14) days without giving any reason.

However, for digital services that are supplied immediately, you expressly request and consent to the immediate performance of the Services upon completion of a Top-Up and acknowledge that you thereby lose your right of withdrawal once performance has begun, to the extent permitted by Applicable Law.

By completing a Top-Up and using the Services, you confirm your express request for immediate performance and your acknowledgment that any applicable withdrawal rights may be lost or limited.

14. Subscription, Renewal & Account Termination

14.1 Subscription Features

Certain features of the Services may be offered on a subscription or recurring basis. Where applicable, the relevant pricing, billing cycle, and renewal terms will be disclosed at the time of purchase.

14.2 Automatic Renewal

Unless otherwise stated, subscriptions will automatically renew at the end of each billing cycle unless canceled prior to the renewal date.

14.3 Cancellation by User

You may cancel your subscription at any time through your Account settings or by contacting support. Cancellation will take effect at the end of the current billing cycle, unless otherwise required by Applicable Law.

14.4 Termination by Company

The Company may suspend or terminate your Account in accordance with Section 9 (Monitoring, Enforcement & Suspension), including for:

  • Violation of these Terms;
  • Fraud or payment-related issues; or
  • Legal or regulatory requirements.

14.5 Effect of Termination

Upon termination of your Account:

  • Your access to the Services will cease;
  • Any remaining balance may be forfeited, except where required by Applicable Law; and
  • The Company may delete or retain certain data in accordance with its legal obligations and internal policies.

15. Logging, Data Handling & Retention

15.1 General Principles

The Company is committed to minimizing the collection and retention of data associated with your use of the Services. We do not intentionally collect or retain more data than is necessary for the provision, security, and improvement of the Services.

15.2 Service-Related Data Processing

In order to operate the Services, the Company may process certain technical data, including request metadata, usage statistics, and system logs.

15.3 Standard service tiers

For standard or entry-level service tiers (such as standard residential plans), the Company may process and retain a limited, sampled portion of proxy request metadata (for example, a small percentage of requests) for purposes including:

  • Debugging and maintaining service reliability;
  • Detecting and preventing fraud, abuse, or misuse; and
  • Monitoring and improving system performance.

Such data is retained for a limited period (typically up to 24 hours) and is thereafter deleted or irreversibly anonymized, except where retention is required for security, legal, or compliance purposes.

15.4 Premium Accounts

For premium or enhanced service tiers (such as premium residential, mobile, datacenter, or ISP proxy plans), the Company may process and retain a broader scope of proxy request metadata for extended periods in order to provide advanced features, analytics, troubleshooting capabilities, and fraud prevention.

Such data is retained only for as long as reasonably necessary to fulfill the purposes described above, including service delivery, security, and compliance with Applicable Law, and is subject to appropriate technical and organizational safeguards.

To the extent reasonably practicable, such data is processed in a manner designed to minimize the identification of individual Users and is not used to profile or track Users beyond what is necessary for legitimate business and security purposes.

15.5 Data Minimization

The Company does not intentionally associate proxy request data with direct user identifiers beyond what is necessary to provide the Services, enforce these Terms, or comply with Applicable Law.

15.6 Security & Access Controls

Access to logs and service-related data is restricted to authorized personnel and is subject to appropriate technical and organizational security measures.

15.8 Legal Basis & Purpose Limitation

Where required by Applicable Law, the Company processes service-related data on the basis of its legitimate interests in providing, securing, and improving the Services, including fraud prevention, abuse detection, and system reliability.

All data processing is limited to what is necessary for these purposes and is carried out in accordance with the principles of data minimization and storage limitation.

16. Privacy & Data Protection

The Company may use automated systems, including fraud detection and risk assessment tools, to evaluate transactions, monitor activity, and protect the integrity of the Services.

  • Suspending or terminating Accounts.

Where reasonably practicable, the Company will attempt to provide advance notice of planned maintenance.

20.3 No Service Level Commitment

21.3 User Responsibility

You acknowledge and agree that:

  • You are solely responsible for how you use the Services;
  • You must not rely on the Services for anonymity or legal compliance; and
  • You assume all risks associated with your use of proxy services.

21.4 Third-Party Detection & Blocking

Third-party websites or services may detect, block, or restrict access from proxy networks. The Company is not responsible for any such actions or for any resulting loss of functionality.

22. Intellectual Property Rights

All rights, title, and interest in and to the Services, including all software, technology, content, trademarks, logos, and intellectual property, are and shall remain the exclusive property of the Company or its licensors.

If you believe that any content or activity associated with the Services infringes your copyright or other intellectual property rights, you may submit a written notice to the Company that includes:

  • Identification of the allegedly infringed work;
  • Identification of the material claimed to be infringing;
  • Your contact information; and
  • A statement that you have a good faith belief that the use is not authorized.

24.3 Counter-Notice

If you believe that your content was removed or restricted in error, you may submit a counter-notice with appropriate supporting information.

24.4 Repeat Infringers

The Company reserves the right to suspend or terminate Accounts of Users who are repeat infringers or who repeatedly violate intellectual property rights.

25. Warranties & Disclaimers

25.1 "As Is" and "As Available"

To the maximum extent permitted by Applicable Law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

The Company expressly disclaims all warranties, including, without limitation:

  • Any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
  • Any warranties that the Services will be uninterrupted, error-free, secure, or free from harmful components; and
  • Any warranties regarding the accuracy, reliability, or results of using the Services.

25.3 No Guarantee of Results

The Company does not guarantee any specific outcomes, performance levels, or success rates resulting from your use of the Services.

25.4 Third-Party Dependencies

The Services rely on third-party infrastructure and services. The Company makes no warranties regarding the availability, reliability, or performance of any third-party services.

25.5 Jurisdictional Limitations

29. Governing Law & Dispute Resolution

29.2 Informal Dispute Resolution

This informal resolution process is a condition precedent to initiating any formal dispute resolution process, except where prohibited by Applicable Law.

29.3 Binding Arbitration

Except as provided in Sections 29.5 and 29.6, any Dispute that cannot be resolved through the informal process described above shall be finally resolved by binding arbitration.

  • Either party may bring an individual claim in a court of competent jurisdiction for matters that are not subject to arbitration under Applicable Law;
  • Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or other proprietary rights; and
  • The Company may pursue claims relating to unpaid fees or fraud in any appropriate jurisdiction.

29.6 Consumer Rights

If you are a consumer residing in a jurisdiction that grants you the right to bring claims in local courts or restricts the enforceability of arbitration agreements, nothing in this Section shall limit or waive such rights.

In such cases, Disputes may be brought before the courts of your country of residence as required by Applicable Law.
